Every state-changing event for HTX FCA UK Enforcement — Illegal Crypto Promotions (2026): moderation decisions on community submissions, plus corrections and updates from the news pipeline. URL-based decisions are designed to carry three independent witnesses — the original source, an Internet Archive snapshot, and a Solana memo signed by our publicly-disclosed publisher key. Archive coverage is still being backfilled, so each decision below reports its own snapshot status rather than assuming one exists.

In October 2022, the platform was acquired by About Capital, a Hong Kong investment firm whose core funder is Justin Sun, founder of the TRON blockchain. Sun initially denied personal involvement in the acquisition but subsequently joined as a member of the global advisory board and was later identified by the exchange as its leader. In 2023 the platform rebranded to HTX — a name combining references to Huobi, TRON, and 'exchange.' The prohibition extends to communications 'capable of having an effect in the UK' regardless of whether the communicator intends to target UK consumers. With effect from 8 October 2023, the FCA extended the financial promotions regime to 'qualifying cryptoassets'. From that date, all firms — including overseas-based entities — marketing cryptoassets to UK consumers have been required to comply. Violation of Section 21 is a criminal offence carrying a maximum penalty of two years' imprisonment and/or an unlimited fine. On the civil side, contracts entered into in reliance on an unlawful promotion may be unenforceable, and consumers may be entitled to a refund plus damages.","heading":"Regulatory Framework: Section 21 FSMA and Cryptoasset Promotions","severity":"high","sources":[{"credibility":2,"name":"FCA Sues HTX for Breaching Financial Promotions Rules — CMS Law","type":"news_article","url":"https://cms.law/en/aut/legal-updates/global-cryptoexchange-sued-by-uk-regulator-for-breaching-financial-promotions-rules"},{"credibility":2,"name":"Injuncting unauthorised promotions: FCA takes action against HTX — DLA Piper Intelligence","type":"news_article","url":"https://www.dlapiperintelligence.com/investmentrules/blog/articles/2026/Injuncting-unauthorised-promotions-fca-takes-action-against-htx"}]},{"content":"The FCA alleges that HTX promoted cryptoasset services to UK consumers through its website and across multiple social media platforms — including TikTok, X (formerly Twitter), Facebook, Instagram, YouTube, Telegram, Discord, Medium, and LinkedIn — in breach of Section 21(1) FSMA. Specific promotional communications cited include homepage registration incentives offering 'up to 1,200 USDT' and social media posts advertising trading rewards. The FCA also documented that in 2023 HTX was the sixth most-accessed digital asset provider in the UK, recording approximately 4.6 million UK site visits that year (declining to approximately 13,000 by 2024 following partial enforcement measures).\n\nTo demonstrate ongoing accessibility to UK residents, an FCA employee conducted a test purchase from a UK IP address, verified their identity using a UK driving licence, purchased cryptoassets through HTX's peer-to-peer service, and executed futures trades on two trading pairs. HTX's terms of service nominally barred UK retail users from derivatives, but the FCA alleges those controls did not technically prevent futures trading. The platform also operated in English, accepted British pounds sterling, and accepted UK-issued photo identification for account verification. The FCA has described HTX's corporate structure as 'opaque', concealing the identities of its beneficial owners and website operators, and stated that repeated engagement attempts went unanswered.","heading":"FCA Allegations and Evidence","severity":"high","sources":[{"credibility":1,"name":"HTX legal proceedings information — FCA official statement","type":"regulatory","url":"https://www.fca.org.uk/news/statements/htx-huobi-legal-proceedings"},{"credibility":1,"name":"Particulars of Claim dated 21 October 2025 — FCA","type":"court_filing","url":"https://www.fca.org.uk/publication/documents/fca-huobi-global-ors-particulars-claim.pdf"},{"credibility":2,"name":"Reaching through the screen: FCA v HTX breaks new ground with 'persons unknown' enforcement — Burness Paull","type":"news_article","url":"https://www.burnesspaull.com/legal-insights-news-events/insights/reaching-through-the-screen-fca-v-htx-breaks-new-ground-with-persons-unknown-enforcement/"},{"credibility":2,"name":"FCA and HTX in settlement talks over unlawful UK crypto promotions — Decrypt","type":"news_article","url":"https://decrypt.co/375551/fca-htx-in-settlement-talks-over-illegal-uk-crypto-promotions-report"}]},{"content":"The FCA filed its Particulars of Claim on 21 October 2025 in the Chancery Division of the High Court. The named defendants are: (1) Huobi Global S.A. (Panama); (2) Persons Unknown — owners and controllers of HTX and associated applications; (3) Persons Unknown — legal entities defined as 'HTX Operators' under the platform's user agreement; (4) Persons Unknown — controllers of social media accounts operated on behalf of HTX; and (5) Persons Unknown — any parties who may become owners or controllers before 31 October 2028.\n\nThe inclusion of a fifth 'future persons unknown' category is described by legal commentators as a 'newcomer injunction', an innovation drawn from other contexts and applied for the first time to offshore crypto enforcement. On 4 February 2026, Deputy Master Dovar granted permission to serve proceedings out of the jurisdiction and by alternative means, given the difficulty of serving a Panamanian entity whose beneficial owners are not publicly identified. Further procedural orders were issued by Deputy Master Valentine on 31 March 2026 and by Chief Master Shuman on 25 June 2026.\n\nThe FCA seeks two forms of relief: (i) a declaration that the defendants contravened Section 21(1) FSMA; and (ii) an injunction restraining future financial promotions in breach of that provision. No criminal charges have been filed; these are civil High Court proceedings. No court ruling on the merits has been issued as of August 2026.","heading":"Court Proceedings and Procedural Innovations","severity":"high","sources":[{"credibility":1,"name":"HTX legal proceedings information — FCA official statement","type":"regulatory","url":"https://www.fca.org.uk/news/statements/htx-huobi-legal-proceedings"},{"credibility":1,"name":"Particulars of Claim dated 21 October 2025 — FCA","type":"court_filing","url":"https://www.fca.org.uk/publication/documents/fca-huobi-global-ors-particulars-claim.pdf"},{"credibility":2,"name":"Reaching through the screen: FCA v HTX — Burness Paull","type":"news_article","url":"https://www.burnesspaull.com/legal-insights-news-events/insights/reaching-through-the-screen-fca-v-htx-breaks-new-ground-with-persons-unknown-enforcement/"},{"credibility":2,"name":"FCA Takes High Court Action Against HTX — Freeths","type":"news_article","url":"https://www.freeths.co.uk/insights-events/legal-articles/2026/crypto-promotions-under-fire-fca-takes-high-court-action-against-htx-as-uk-clampdown-intensifies/"}]},{"content":"Prior to filing suit, the FCA pursued enforcement through platform intermediaries. TikTok blocked UK user access to HTX's account in February 2024. Meta removed HTX's accounts in May 2024. Telegram blocked HTX's channels for UK users in October 2024. The FCA also placed HTX on its Warning List in October 2023, notified Google and Apple to remove HTX applications from their UK app stores, and issued at least two written warnings to HTX before commencing litigation. HTX restricted new UK customer registrations after proceedings were filed in late 2025; however, the FCA noted that existing UK users retained access to what the regulator characterises as unlawful promotions, and HTX gave no assurance that the registration restriction would be permanent.","heading":"Pre-Litigation Intermediary Enforcement","severity":"medium","sources":[{"credibility":1,"name":"FCA takes action against HTX to stop illegal financial promotions — FCA press release","type":"regulatory","url":"https://www.fca.org.uk/news/press-releases/fca-action-against-htx-illegal-financial-promotions"},{"credibility":2,"name":"FCA Brings First Enforcement Action Against Offshore Cryptoasset Firm HTX — Prokopiev Law","type":"news_article","url":"https://www.prokopievlaw.com/post/fca-brings-first-enforcement-action-against-offshore-cryptoasset-firm-htx-february-2026"}]},{"content":"As of August 2026, the FCA and HTX are in settlement negotiations. The parties exchanged emails from March 2026, representing the first substantive engagement between the two sides. HTX has publicly maintained that 'it does not serve the UK market' and has stated a commitment to compliance and user protection, positions it has not yet tested in court. Neither party has disclosed the terms under discussion. No settlement has been announced as of the date of this investigation; the case remains open. The UK government stated it had reasonable grounds to suspect HTX provided financial services linked to the A7 network, a payments network that allegedly issued the ruble-pegged A7A5 stablecoin and was used to channel an estimated $1.5 billion back into Russia through a Kyrgyz bank and a major cryptocurrency exchange, reportedly representing roughly half of Russia's annual military expenditure at the time. The UK Treasury confirmed that the sanctions designation extends to the online HTX exchange. As a result of the designation, it became a criminal offence for any UK person or UK-regulated firm to process transactions to, from, or via HTX. Major exchanges including Binance, OKX, Bybit, and Bitget announced enhanced compliance reviews for HTX-linked transfers. HTX disputed the allegations, stating that 'the listed entity Huobi Global S.A. is distinct from the online HTX exchange' and that the exchange had rejected listing applications for the A7A5 stablecoin. These are allegations; no court has adjudicated the sanctions designation.","heading":"UK Russia Sanctions Designation (May 2026)","severity":"critical","sources":[{"credibility":1,"name":"HTX Sanctioned by UK for Allegedly Aiding Kremlin in Moving $1.5 Billion — Bloomberg","type":"regulatory","url":"https://www.bloomberg.com/news/articles/2026-05-26/crypto-firm-htx-sanctioned-by-uk-for-helping-kremlin-move-money"},{"credibility":2,"name":"UK Sanctions Crypto Companies With Russia Ties — Chainalysis","type":"research","url":"https://www.chainalysis.com/blog/uk-sanctions-crypto-entities-russian-trade-blockade-evasion-may-2026/"},{"credibility":2,"name":"Major crypto exchanges increase transfer scrutiny with HTX over UK sanctions — CoinDesk","type":"news_article","url":"https://www.coindesk.com/business/2026/05/27/major-crypto-exchanges-increase-transfer-scrutiny-with-htx-over-uk-sanctions"},{"credibility":2,"name":"Official Update: HTX Addresses UK Sanctions Against Huobi Global S.A. — Yahoo Finance","type":"official","url":"https://finance.yahoo.com/markets/crypto/articles/uk-sanctions-justin-sun-htx-140251707.html"},{"credibility":2,"name":"UK Designates HTX: What the Biggest Crypto Sanctions Action Yet Means for Compliance Teams — TRM Labs","type":"research","url":"https://www.trmlabs.com/resources/blog/uk-designates-htx-what-the-biggest-crypto-sanctions-action-yet-means-for-compliance-teams"}]},{"content":"The FCA v HTX proceedings are described by legal commentators as the FCA's most significant crypto marketing enforcement action to date and the first time the regulator has taken a crypto firm to the High Court over promotional-regime violations. The use of 'persons unknown' defendants and a 'newcomer injunction' extending to future controllers through October 2028 represents a novel legal technique aimed at closing structural gaps created by opaque offshore corporate arrangements. Legal analysis published by Burness Paull notes that, should a court grant the newcomer injunction, it would set a precedent enabling future enforcement against any offshore platform regardless of beneficial owner identity. The UK's May 2026 Russia sanctions designation of Huobi Global S.A. — the first time a UK designation has directly named a crypto exchange of this scale — creates additional legal exposure for HTX beyond the FCA enforcement track.","heading":"Significance and Industry Context","severity":"high","sources":[{"credibility":2,"name":"Reaching through the screen: FCA v HTX breaks new ground with How verification works. The “Row integrity” check above is computed in your browser — your machine recomputes the SHA-256 of the canonical bytes and compares against the stored hash. No avoid.net server can fake that check. The “full verify” link goes one level deeper: your browser fetches the on-chain transaction from a Solana RPC node and confirms the same hash is in the memo. If you don’t want to trust either avoid.net or the public RPC, run the CLI verifier on your own machine — python -m src.verify_decision <event_id>.
