In the initial phase, beginning at least in July 2013, investors were recruited through a multi-level marketing structure and told that USFIA owned large and valuable amber mines in Argentina, the Dominican Republic, Mexico, and the United States. Investors paid between $1,000 and $30,000 each for USFIA membership or investment packages, with higher returns promised for recruiting additional participants. Chen and his associates falsely claimed that a lucrative initial public offering for USFIA was imminent, which never occurred. In September 2014, the defendants pivoted and claimed to convert existing investors' holdings into 'Gemcoins,' a virtual currency they described as secured by the company's amber and gemstone holdings. Promotional claims included assertions that Gemcoin's backing exceeded $15 billion, that the tokens had 'zero chance of devaluation,' and that they would grow exponentially every two months. Approximately 2,000 ATM platforms were falsely claimed to allow conversion of coins to currency. When independent appraisers examined the chunks of amber that USFIA physically distributed to investors, the amber proved to be nearly worthless fossilized tree sap. The SEC found no evidence of any legitimate gemstone mining business; between July 2011 and May 2015, approximately $32 million entered USFIA's primary bank account, of which approximately $19 million arrived via Asian wire transfers and $5.7 million through U.S. checks, with no significant legitimate business revenue. Leonard Stacy Johnson, 54, of Huntington Beach, who served as USFIA's Vice President of Investor Relations and worked at Chen's direction to promote USFIA and Gemcoin, pleaded guilty in July 2019 to one count of tax evasion and one count of making a false statement on an immigration document. Johnson cooperated substantially with the government; his sentencing guideline offense level was reduced from 13 to 8 as a result, and he was sentenced to two years probation and ordered to pay $45,871 in restitution. Steve Chen himself agreed to plead guilty in February 2020 to one count of conspiracy to commit wire fraud and one count of tax evasion. At the time of his plea, the government's evidence showed that Chen had obtained approximately $147 million from approximately 72,000 victims between July 2013 and September 2015, constituting one of the largest pyramid schemes ever prosecuted in the Central District of California. On the tax evasion count, Chen had reported gross income of $138,015 for tax year 2014 when his actual income was approximately $4,816,193, resulting in $1,885,094 in unpaid taxes. On January 10, 2021, Judge John F. Walter sentenced Chen to 120 months (ten years) in federal prison — the mandatory minimum under the plea agreement — and ordered him to pay $1,885,094 in restitution to the IRS.
