From that date any firm serving EU/EEA clients without a CASP authorisation is in breach of EU law, and a large majority of previously registered firms, including major offshore exchanges such as Binance, MEXC, Bitget, HTX and CoinEx, had not obtained one. Estimates of the share left unlicensed range from about 80–83% to almost 90%, depending on the source and the date measured. The cluster has produced at least one documented consumer-harm event (the AscendEX shutdown and withdrawal freeze) and alleged circumvention of the onboarding ban (MEXC). Public warning lists of non-compliant firms are acknowledged to be incomplete.","sections":[{"content":"The Markets in Crypto-Assets Regulation (Regulation (EU) 2023/1114, MiCA) was published in the Official Journal of the European Union on June 9, 2023 and entered into force on June 29, 2023. It establishes a harmonised framework for crypto-asset service providers operating in the European Economic Area, replacing divergent national regimes. Any firm providing crypto-asset services to EU/EEA clients (exchange, custody, transfer, advisory) must obtain CASP authorisation from a national competent authority (NCA) of at least one member state; that authorisation passports across all 27 EU member states and the wider EEA.\n\nMiCA was implemented in phases. Its stablecoin provisions (Titles III and IV, on asset-referenced tokens and e-money tokens) applied from June 30, 2024, and its CASP provisions became fully applicable across all member states on December 30, 2024. Existing national VASP registrants were then allowed a transitional (grandfathering) period of up to 18 months, which ended on July 1, 2026. Some member states ended it earlier: the Netherlands in July 2025 and Germany on December 31, 2025, according to Bitcoin Market. Sources describe the July 1, 2026 date differently: the survivor page called it the date MiCA 'entered full application' and 'full enforcement', while other sources treat it as the end of the transitional period, with MiCA fully applicable since December 2024.\n\nAfter July 1, 2026 ESMA stated: 'Any entity providing crypto-asset services within the European Union without a MiCA licence will be in breach of EU law and must cease such services.' No intermediate 'pending' status confers continued operating rights. France's AMF has also warned that unauthorised firms soliciting EU clients may face criminal prosecution.","heading":"Regulatory Background: MiCA and the CASP Framework","sources":[{"url":"https://www.esma.europa.eu/esmas-activities/digital-finance-and-innovation/markets-crypto-assets-regulation-mica","name":"ESMA — Markets in Crypto-Assets Regulation (MiCA) official page","type":"regulatory","credibility":1},{"url":"https://www.esma.europa.eu/sites/default/files/2026-06/ESMA75-113276571-1710_Public_Statement_MiCA_transitional_period_ends.pdf","name":"ESMA Public Statement: End of MiCA Transitional Period (June 2026 PDF)","type":"regulatory","credibility":1},{"url":"https://elvingerhoss.lu/insights/publications/mica-end-transitional-period-1-july-2026","name":"Elvinger Hoss – MiCA: end of the transitional period on 1 July 2026","type":"other","credibility":2},{"url":"https://www.nortonrosefulbright.com/en/inside-fintech/blog/2026/05/esma-clarifies-supervisory-expectations-on-mica-transitional-period","name":"Norton Rose Fulbright – ESMA clarifies supervisory expectations on MiCA transitional period","type":"other","credibility":2},{"url":"https://www.amf-france.org/en/news-publications/depth/mica","name":"AMF France — The European regulation Markets in Crypto-Assets (MiCA)","type":"regulatory","credibility":1},{"url":"https://www.innreg.com/blog/mica-regulation-guide","name":"InnReg — MiCA Regulation Guide 2026","type":"research","credibility":2},{"url":"https://www.klgates.com/The-Regulation-on-Markets-in-Crypto-Assets-Becomes-Fully-Applicable-in-All-Member-States-of-the-European-Union-1-24-2025","name":"K&L Gates – The Regulation on Markets in Crypto-Assets Becomes Fully Applicable in All Member States of the European Union","type":"other","credibility":2},{"url":"https://bitcoinmarket.net/magazine/mica-deadline-july-2026.html","name":"Bitcoin Market — MiCA Deadline July 2026: Which Exchanges Are Licensed and Which Are Leaving Europe","type":"news_article","credibility":2}],"severity":"high"},{"content":"On April 17, 2026, ESMA published a formal statement on the end of the MiCA transitional periods. It confirmed that the transitional period would end on July 1, 2026 and that any firm continuing to serve EU clients without authorisation after that date would be in breach of EU law and subject to enforcement by national regulators. The statement set out three groups of obligations:\n\n- Unauthorised CASPs: immediately stop onboarding new EU clients; have wind-down plans that are 'operational, credible, and immediately executable', including orderly client offboarding with prior notice and transfer of client crypto-assets to an authorised CASP or a self-hosted wallet before July 1, 2026.\n- Authorised CASPs: 'actively manage' the migration of existing clients before July 1 and ensure AML/CFT compliance during onboarding.\n- National competent authorities: verify the adequacy of unauthorised CASPs' wind-down plans and be 'prepared to take action against the unauthorized provision of crypto-asset services' after July 1, cooperating with other member states on cross-border cases.\n\nThe statement also addressed reverse solicitation: retail investors may request services from non-EU providers under narrow conditions, but this does not allow non-EU platforms to market actively into the EU. Spain's CNMV chair Carlos San Basilio was reported as confirming that no waivers or deadline extensions would be granted. ESMA had issued an earlier statement on the transitional measures in December 2025, and issued a further public statement on June 28, 2026, ahead of the deadline, ordering unlicensed firms to halt new registrations.","heading":"ESMA Statements: No Extensions, Orderly Wind-Down Required","sources":[{"url":"https://www.esma.europa.eu/sites/default/files/2026-04/ESMA75-113276571-1679_Statement_on_the_end_of_transitional_periods_under_MiCA.pdf","name":"ESMA — Statement on the end of transitional periods under MiCA (April 2026)","type":"regulatory","credibility":1},{"url":"https://www.esma.europa.eu/sites/default/files/2025-12/ESMA75-113276571-1631_Statement_on_end_of_MiCA_transitional_periods.pdf","name":"ESMA Statement on MiCA Transitional Measures (December 2025 PDF)","type":"regulatory","credibility":1},{"url":"https://www.esma.europa.eu/sites/default/files/2026-06/ESMA75-113276571-1710_Public_Statement_MiCA_transitional_period_ends.pdf","name":"ESMA Public Statement: End of MiCA Transitional Period (June 2026 PDF)","type":"regulatory","credibility":1},{"url":"https://www.regulationtomorrow.com/2026/04/esma-statement-on-the-end-of-transitional-periods-under-mica/","name":"Regulation Tomorrow – ESMA statement on the end of transitional periods under MiCA","type":"news_article","credibility":2},{"url":"https://www.blockchainwg.eu/esma-publication-of-its-statement-on-the-end-of-transitional-periods-under-micar-17-april-2026/","name":"Blockchain Working Group – ESMA publication of its statement on the end of transitional periods under MiCAR, 17 April 2026","type":"other","credibility":2},{"url":"https://www.harneys.com/our-blogs/regulatory/1-july-2026-mica-cut-off-esma-s-statement-on-the-end-of-mica-transitional-periods/","name":"Harneys – 1 July 2026 MiCA cut off: ESMA's statement on the end of MiCA transitional periods","type":"other","credibility":2},{"url":"https://easternherald.com/2026/07/02/mica-casp-deadline-eu-crypto-firms-unlicensed-2026/","name":"Eastern Herald – 83% of EU Crypto Firms Missed MiCA's July 1 Deadline. These firms either did not complete the application process, withdrew, or exited the EU market. The ESMA CASP register showed about 244 authorised entities on June 28, 2026, up from about 40 in May 2025.\n- FinTelegram reported that more than 3,000 CASPs operated across Europe under legacy national registrations before the deadline, and that as of July 31, 2026 only 321 to 322 active entries appeared in the ESMA CASP register, fewer than 11% of previously operating entities.\n\nOf the top 100 exchanges globally by trading volume, only 16 held confirmed MiCA authorisation as of the enforcement date, according to Hyperdash and other trackers. By jurisdiction, Germany led with 56 CASP authorisations, the Netherlands issued 26 and France 21; 10 EEA states, including Croatia, Estonia, Greece, Hungary, Iceland, Italy, Norway, Poland, Portugal and Romania, had issued no MiCA licences before the deadline. About 90 operators in France alone were reported to lack MiCA licences at the deadline.\n\nEstimates also differ on how much activity the unlicensed firms account for. Finance Magnates reported that licensed platforms already handled about 95% of EU crypto transaction volume by value, while Eastern Herald's analysis estimated that about 30% of EU crypto transaction volume still flowed through unlicensed platforms at the deadline. The combined EU user base of the non-compliant major exchanges has been put at over 25 million accounts; this is an industry estimate rather than exchange disclosure and should be treated as indicative. Binance alone was separately reported to have about 40 million EU user accounts (see the Binance section).\n\nThe ESMA non-compliant entity register (the NCASP file) recorded 167 flagged entities as of August 5, 2026. It is acknowledged to be incomplete: 165 of the 167 entries came from Italy's CONSOB, and the only other contributors were the Netherlands AFM and Slovakia's NBS. Absence from the NCASP list does not indicate compliance.","heading":"Scale of Non-Compliance","sources":[{"url":"https://easternherald.com/2026/07/02/mica-casp-deadline-eu-crypto-firms-unlicensed-2026/","name":"Eastern Herald – 83% of EU Crypto Firms Missed MiCA's July 1 Deadline. The exchange permanently halted trading, deposits, staking and swap services effective July 1, 2026, the same date the transitional period ended, after failing to obtain MiCA CASP authorisation and after a strategic liquidity transaction it had relied on failed to close.\n\nAscendEX issued a public notice on July 6, 2026, five days after operations stopped, citing MiCA compliance requirements, the failed strategic transaction and deteriorating market conditions. All remaining withdrawals were placed under mandatory manual review with no guaranteed timeline or amount; the platform said it was 'not in a position to give assurances about timing or amounts' and warned that insolvency proceedings could follow if financial gaps were not resolved.\n\nOn-chain analysis reported by TechTimes found that an AscendEX-labelled address held about $13.45 million in crypto assets as of July 8, 2026, more than $12 million of it in the exchange's own ASD token and the UNITE token, illiquid assets insufficient to meet withdrawal demand. A separate on-chain analysis identified a reserve drop of more than $240 million from an AscendEX address on June 20, 2026, about 10 days before the shutdown.\n\nUsers lack clarity on which legal entity holds their assets, in which jurisdiction any insolvency case would proceed, or whether any deposit protection applies. The AFM noted that MEXC was 'no longer registered in a trade register', leaving its legal domicile unclear, and cited active marketing to Dutch consumers, including sponsorship of a Dutch blockchain conference. MEXC does not appear on the ESMA CASP register, and was described by CASP Tracker as the most widely recognised named exchange on the ESMA non-compliant list as of August 5, 2026.\n\nIn June 2026 MEXC issued an official notice advising EU users to complete all withdrawals before July 1, 2026, citing MiCA requirements. FinTelegram's reporting gives a different picture of MEXC's behaviour after the deadline. Posing as an EU resident on July 1, 2026, FinTelegram said it completed registration and advanced KYC on MEXC as an EU national, and that no MiCA restriction notice, wind-down disclosure or regulatory status warning appeared during onboarding or in follow-up emails.\n\nLater FinTelegram reporting alleged that MEXC had set up a multi-layer payment relay routing EU customer deposits through third-party intermediaries, including entities in Romania, France and Australia and a MiCA-authorised Irish payment layer (FinTelegram names Heuro and Ocean Wave), while keeping MEXC's core trading and deposit experience accessible to EU users. If accurately described, this would be an attempt to use licensed front-end payment entities to route EU funds to an unlicensed offshore trading venue, which would likely breach both MiCA and payment-services rules.\n\nMEXC's CEO said in 2026 that obtaining a MiCA licence was 'a top strategic priority', and MEXC reportedly told Dutch-linked users that its Dutch services would cease on October 23, 2026. No MiCA CASP application or authorisation had been announced at the time of the survivor page's research. The circumvention findings come mainly from FinTelegram (an investigative publication on financial and regulatory compliance) and the payment-relay structure has not been independently verified; the allegations are unproven.","heading":"MEXC: Warnings, Wind-Down Notice and Alleged Post-Deadline EU Onboarding","sources":[{"url":"https://www.afm.nl/en/sector/actueel/2025/sep/mr-mexc-waarschuwing","name":"AFM — Consumer warning against MEXC (September 2025)","type":"regulatory","credibility":1},{"url":"https://casptracker.eu/exchange/mexc/","name":"CASP Tracker — MEXC exchange MiCA status","type":"research","credibility":2},{"url":"https://casptracker.eu/esma-crypto-warning-list/","name":"CASP Tracker — ESMA crypto warning list 2026","type":"research","credibility":2},{"url":"https://www.mexc.com/news/1181664","name":"MEXC – MiCA's transitional period ends July 1. It said it had engaged 'constructively and in good faith' with the Greek authorities but that no formal decision was forthcoming before the transitional period closed. Reuters had previously reported that the Greek regulator was 'set to reject' the application.\n\nEuronews reported on June 25, 2026 that Binance would halt crypto services across EU countries, and on June 26, 2026 Binance notified EU users, including in France, Italy, Poland and Spain, that it would stop providing services from July 1, 2026, halting new registrations across the EU. Binance said user assets 'remain safe and secure, and will remain accessible at all times', with withdrawals remaining open, and said it intended to seek MiCA authorisation in France and return to the EU market within months. On July 3, 2026 CoinDesk reported Binance pushing back on reports that EU regulators had tried to block it, saying MiCA 'should be judged by who it licenses, not who it excludes'.\n\nSources differ on Binance's French status. The survivor page reported that Binance's French subsidiary (Binance France S.A.S.) had received AMF authorisation, giving a possible path to regulated re-entry; the merged page said Binance intended to reapply in France, where it held a prior AMF digital asset service provider (PSAN) registration, and noted only that some sources indicate an authorised Binance France entity existed while the halt affects the global platform's EU-facing services.\n\nBinance's exit was orderly rather than distressed, which separates it from smaller non-compliant exchanges where insolvency risk accompanies non-compliance. ESMA guidance limits this strictly: it cannot be invoked systematically, cannot be established by contractual disclaimers alone, and does not permit active marketing to EU clients. Some exchanges are alleged to exploit the grey zone by letting EU users self-register without overt solicitation while staying functionally accessible.\n- Payment relay architectures: as alleged in the MEXC case, offshore exchanges may route EU deposits through chains of licensed third-party payment entities while keeping the trading platform accessible. Detecting and prosecuting this requires cross-border regulatory coordination.\n- Fragmented national enforcement: enforcement is decentralised, with each NCA the primary enforcer in its jurisdiction and ESMA coordinating. The ESMA NCASP file is built from voluntary NCA submissions, and as of August 5, 2026, 165 of its 167 entries came from Italy's CONSOB, so a non-compliant exchange operating in France, Germany or Spain may appear on no public warning list. Differences in national enforcement pace create jurisdictional arbitrage.\n- Opaque application queues: some exchanges may be operating under informal forbearance while applications are pending. No segregated fund protection: under MiCA Article 70, authorised CASPs must segregate client crypto-assets from firm assets, meet sub-custody disclosure requirements and maintain capital buffers. Unauthorised exchanges have no such obligation under EU law, so client assets may be commingled with operating funds, as alleged in the AscendEX case.\n2. No regulated complaints or dispute resolution: authorised platforms must offer formal complaints procedures and access to alternative dispute resolution, and must give standardised disclosure on pricing, risks and fees. Users of unlicensed exchanges lose these, along with MiCA's AML/CFT oversight, governance and conduct-of-business rules.\n3. Compensation: sources disagree. The survivor page stated that users of licensed CASPs in some member states benefit from investor compensation mechanisms and that unlicensed users lack 'the investor compensation guarantee MiCA mandates'. The merged page, citing Finance Magnates, Legal Nodes and Narvi, states that MiCA does not create a deposit guarantee or investor compensation scheme comparable to the Deposit Guarantee Schemes Directive, and that crypto-assets are explicitly excluded.\n4. Sudden service termination: non-compliant exchanges under regulatory pressure may restrict accounts, disable deposits, halt trading or freeze withdrawals with little or no notice; AscendEX users learned of the freeze after it had happened.\n5. Jurisdictional opacity: non-compliant exchanges often operate from offshore jurisdictions with unclear legal domicile, leaving users unsure which entity holds their assets or where insolvency proceedings would be heard.\n6. Recovery scams: users of distressed or shut-down exchanges are frequently targeted by fraudulent 'fund recovery' services. Any third party offering to recover frozen exchange assets for an upfront fee should be treated as a scam.\n7. Cascading liquidity risk: an exchange outside MiCA's capital and reserve requirements may reach insolvency faster if regulatory pressure coincides with market stress or a failed liquidity event, as in the AscendEX case.","heading":"Consumer Risk Factors for EU Users on Non-Compliant Exchanges","sources":[{"url":"https://finance.yahoo.com/markets/crypto/articles/5-scary-things-happen-crypto-091557768.html","name":"Yahoo Finance — 5 Scary Things That Happen to Your Crypto if Your Exchange Loses Its MiCA License on July 1","type":"news_article","credibility":2},{"url":"https://www.bleap.finance/en-us/blog/mica-july-1-2026-deadline","name":"Bleap Finance — MiCA July 1, 2026: What the Deadline Means for Crypto Firms and EU Investors","type":"news_article","credibility":2},{"url":"https://cryptoslate.com/ascendex-shuts-down-after-mica-miss-and-warns-some-withdrawals-may-not-be-processed/","name":"CryptoSlate — AscendEX shuts down after MiCA miss and warns some withdrawals may not be processed","type":"news_article","credibility":2},{"url":"https://cryptodaily.co.uk/2026/06/how-non-custodial-wallets-protect-users-after-micas-july-2026-enforcement","name":"Crypto Daily — How Non-Custodial Wallets Protect Users After MiCA's July 2026 Enforcement","type":"news_article","credibility":2},{"url":"https://www.financemagnates.com/cryptocurrency/regulation/europes-crypto-market-after-july-1-who-stays-who-leaves-and-what-changes-under-mica/","name":"Finance Magnates – Europe's Crypto Market After July 1: Who Stays, Who Leaves, and What Changes Under MiCA","type":"news_article","credibility":2},{"url":"https://www.legalnodes.com/article/mica-regulation-explained","name":"Legal Nodes – The EU Markets in Crypto-Assets (MiCA) Regulation Explained","type":"other","credibility":2},{"url":"https://narvi.com/blog/mica-eu-regulation","name":"Narvi – MiCA explained for non-lawyers: a 2026 guide for EU businesses","type":"other","credibility":2},{"url":"https://easternherald.com/2026/07/02/mica-casp-deadline-eu-crypto-firms-unlicensed-2026/","name":"Eastern Herald – 83% of EU Crypto Firms Missed MiCA's July 1 Deadline.
